我国农民专业合作社社员权的诉权保护——以社员代表诉讼的制度构建为中心

摘　　要：实践中,我国农民专业合作社及其社员合法权益遭受侵害的现象屡见不鲜,然而,我国现行《农民专业合作社法》对此却缺乏相应救济手段。《农民专业合作社法》修改时应当增加社员权的诉权保护。诉权的具体表现形式是社员直接诉讼和社员代表诉讼。社员直接诉讼旨在保护社员个人利益,社员代表诉讼则旨在保护农民专业合作社利益进而保护社员利益。本文即重点针对社员代表诉讼进行制度构建与制度完善。In practice,it is very common that specialized farmers cooperatives and their members' rights and interests have been violated in our country. However,the current Law on Specialized Farmers Cooperatives lacks corresponding legal remedies. Both 2013 and 2015 No.1 Central Documents clearly put forward to revise the Law on Specialized Farmers Cooperatives. At present,the revision of the Law on Specialized Farmers Cooperatives has been included in the legislative plan of the National People's Congress. The revised Law on Specialized Farmers Cooperatives should provide right of action to member's right. In other words,the revised Law on Specialized Farmers Cooperatives should contain member's direct action and member's representative action. The former aims to protect the member's individual interests,while the latter aims to protect the interests of the specialized farmer's cooperatives. This paper chiefly discusses the member's representative action.
