摘　　要：经济活动的法治环境是指在生产、分配、交换、消费的过程中,法律赋予管理者管理经济活动的权力与经济活动主体参与经济活动的权利及其运行所形成的一种氛围。经济活动的法治环境属于社会文化环境,是与经济活动相关的法律氛围,属于社会人文环境,具有区域性特点。它以系统的经济方面的立法为基础,加之公平的经济行政执法,公正的经济司法以及经济活动主体对法遵守等要素构成。其类型可以从不同的角度进行划分,根据经济活动的产业特征可以划分为单一产业型法治环境和综合产业型法治环境;根据经济活动法治环境形成的动因划分为国家主导型法治环境和市场需求型法治环境。经济活动法治环境具有对经济活动的规制作用、保障作用和塑造作用。The legal environment of economic activity is the atmosphere that the law endows the administrators economic activity and the right that economic management subjects participate in economic activity in the process of production, distribution, exchange and consumption. Legal environment of economic activity is a kind of sociocultural environment, and is related to economic activity. It has regional characteristics. It is made up of system economic legislation, impartial economic administrative law enforcement, just economic judicature and observing law of economic activity subjects. The type can be divided into a single industry type of legal environment and a comprehensive industry type of legal environment from different angles according to industrial characteristics of e- conomic activity. The legal environment of the national leading and the legal environment of consumer demand regulation are divided according to the reason of the form of economic legislation of economic activities. The legal environment of economic activity has the function of regulation, security and mold.
