死刑制度的修改与发展趋势——以《刑法修正案(九)》为视角

摘　　要：死刑制度的修改是调整刑罚结构乃至刑法改革中的一个重要问题。《刑法修正案(九)》对于死刑制度的修改具有总则与分则同时修改;被废除的死刑罪名大多是备而不用或备而少用;同时废除暴力犯罪与非暴力犯罪的死刑罪名,并且以非暴力犯罪的死刑罪名为主;废除死刑与限制死刑并存等特点。但仍存在死缓制度的修改不彻底;与联合国公约的规定存有差距;仍有废除死刑罪名的可能性等问题。因此,未来的立法应该明确死缓的法律地位,提高死缓执行死刑的标准;死刑适用标准借鉴《公民权利与政治权利国际公约》中"最严重的罪行"的国际规定;死刑政策立法化,使其不仅能发挥政策的指导作用,而且能彰显法律的强制效力。The reform on the death penalty system is an important issue of regulating the penalty structure and the penal reform. The modification of the death penalty system in‘amendment to the criminal law（nine）＇has the following characteristics： firstly,while modifying general provisions and specific provisions of criminal law;secondly,the abolition of death penalty charges are less prepared or ready just in case;thirdly,in the abolition of death penalty charges,while with violent crime and non-violent crime,and mainly in non-violent crime;fourthly,while with abolish death penalty and limit death penalty. But there are still some questions as such： the modification of the reprieve system of death penalty is not enough;no commensurate with the provisions of the United Nation＇s Convention and still with room for the abolition of the death penalty. Therefore, The legislative amendment of the reprieve system of death penalty should improve it＇s legal status and the standard of the change from reprieve to the immediate implementation of death penalty;As the applicable standard of death penalty, we should learn from the provisions of‘the most serious crime＇in International Convention on Civil and Political Rights;Further let the death penalty policy be determined by law, make it not only play a guiding role in policy, but also to highlight the legal effect of the law.
