摘　　要：最高人民检察院的司法解释是我国司法解释的重要组成部分。相对于最高人民法院的司法解释,最高人民检察院的司法解释具有解释对象只限于检察工作中具体应用法律问题、解释内容侧重于刑事法和程序法、本质上体现了法律监督属性三大特征。最高人民检察院的司法解释具有体制合理性、功能正当性和实践必要性,在保障检察人员正确理解法律,促进司法办案尺度的统一;弥补立法和立法解释迟延之不足,为立法或者立法解释积累司法经验;弥合司法机关之间对具体应用法律问题的认识分歧,促进公正司法,维护司法权威等方面发挥着重要作用。最高人民检察院司法解释工作应当遵循合法原则、必要原则、科学原则、协调原则、公开原则,加强计划性、时效性、协同性、系统化和建立效果评估机制。The judicial interpretation of the Supreme People＇s Proeuratorate is an important part of the judicial interpretation system in China. The development of the judicial interpretation of the Supreme People＇s Procuratorate has experienced three stages, which are exploration, development and standardization. Compared to the judicial interpretation issued by the Supreme People＇s Court, the judicial interpretation of the Supreme People＇s Procuratorate has three unique features, which are the objects interpreted have been limited in the specific ＂application of legal issues, the contents interpreted focuses on criminal law and procedural law, and the nature reflects the legal supervision. The interpretation of the Supreme People＇s Procuratorate has institutional rationality, functional legitimacy and practical necessity, and it plays an important role in promoting the unification of judicial scale, making up the shortcomings of lawmaking, accumulating judicial experiences for lawmaking, correcting the mistakes of the application of law, promoting the judicial justice, and maintaining judicial authority. The judicial interpretation works of the Supreme People＇s Procuratorate shall follow the principle of legitimate, the principle of necessity, the scientific principle, the principle of coordination, the principle of open, further establish the relevant performance evaluation mechanism.
