南海争议海区的单方开发问题及应对

摘  要:南海仲裁案使我们进一步明确认识到"搁置争议、共同开发"仍然是解决南海争议的现实可行方案,共同开发的制度化是有效约束单方开发的必要途径,而东盟在构建南海共同开发法律体制方面的作用不容忽视。我国的共同开发策略长期难以付诸实践,主要问题表现为周边国家的单方开发缺乏制约,根本原因在于共同开发原则缺乏国际法律制度的规范。周边国家的单方开发行为大部分都不符合《联合国海洋法公约》,却在实际上攫取了争议海区的经济、政治和战略价值,使我国在该区域的共同开发权益受到实质阻碍,并面临既存权问题的困扰。由此我国应当从构建命运共同体的战略高度加以思考应对,积极展开双轨谈判、适时实施单方开发、认真应对既存权、扩大和增进国际合作。South China Sea Arbitration makes us realize that a feasible alternative for settling the territorial disputes in the South China Sea is setting aside dispute and pursuing joint development ". The institutionalization of joint development is an effective way to restrict unilateral exploitation. ASEAN' s influence upon the construction of the legal framework for joint development in the disputed waters shall not be neglected. China' s policy of joint development cannot be put into practice for a long time, because there is no effective way to restrain surrounding countries' unilateral exploitation. The primary cause is that the principle of joint development lacks the regulation by international legal system. The surrounding countries' unilateral exploitation is mainly in conflict with the Convention on the Law of the Sea, and seizes the political, economic
