走出国际组织法的迷思——试论何谓国际组织法

摘　　要：国际组织法虽然久被视为国际法的一个分支,但由于国际组织的多样性、异质性,国内外学界对何谓国际组织法的诠释始终众说纷呈,莫衷一是。国际社会不存在一个普适于所有国际组织的统一法典,实践中主要表现为各个国际组织特有的法律秩序。所谓国际组织法实际上是规范国际组织创立和运作的原则、规则、章程和制度的总称,应该从规范意义和学科意义两个层面来理解,既包括每一个组织各具特色的具体的法律规范,也包括所有国际组织共同面对的法律问题、法律规则和制度。对国际组织法的不同理解引发出不同的研究方法和理论。国际组织法由国际法性质的规范与内部法性质的规范共同组成,具有多样性分类和有别于国际法其他分支的学科体系。其实践既构成国际法不可或缺的一部分,同时也对国际法的发展产生多方面影响。Notwithstanding that the law of international organizations is a well-established branch of the international law, no consensus has been reached among scholarships as to what constitutes the law of international organizations, largely arising out from the fact of heterogeneity and diversity of international organizations. There exists no uniform code in international society that is universally applicable to all international organizations, other than fragmented specific legal orders of each individual organization. The law of international organizations is in practice used as a generic term referring to principles, rules, constitutions and institutions that govern the creation and operation of international organizations. It comprises of not only the specific legal norms of each individual organization, but also the principles, rules and institutions that are common to all international organizations. This body of law includes both the rules of the international law and the internal rules of international organizations, as such is different from other branches of the international law. The law of international organizations can be understood either in a normative sense or from a disciplinary perspective. Different understandings about the law of international organizations often entail different theoretical approaches. The practice of international organizations contributes significantly to the development and enforcement of the international law.
