论我国法律解释体制中的决议体制和立法法体制  

On the "Resolution" System and the "Legislation Law" System in Legal Interpretation System of our Country

摘　　要：现行法律解释体制是按照1981年《全国人民代表大会常务委员会关于加强法律解释工作的决议》构建的,在法律实施中形成了法律解释体制的多元格局和混乱局面。以《立法法》为中心的法文件群则显示了一种全新的法律解释体制框架即立法法体制的存在,依新法优于旧法的原则,应废止决议体制,以全国人大常委会和最高人民法院为主体重构法律解释体制,其中,全国人大常委会是法律解释的监督者,法律解释权主要由最高人民法院行使。应当把立法法体制作为我国法律解释体制的发展方向。Our country＇s current legal interpretation system was established according to ＂Resolution on strengthening the legal interpretation by the National People＇s Congress Standing Committee＂ in 1981, which has caused a diversified pattern and confused situation in the legal interpretation system in the execution of laws. However, the legal document group with ＂Legistation Law＂ as the eore show a complete new legal interpretation system, i.e. the presence of Legislation Law system. The Resolutin System should be abandoned according to the principle of new law being superior to old law, and the Natinal People ＇s Congress Committee and the Supreme People＇s Court shall be the subject to restructure the legal interpretation system. The National People＇s Congress Standing Committee shall be the supervisor of legal interpretation, and the Supreme People＇s Court shall be responsible [or legal intepretation. The Legislation Law system should be the development direction of our country＇s legal interpretation system.
