《警察法》完善方向:基于法律性质的视角

摘　　要：《警察法》的法律性质的定位是其修改完善的前提,关系其调整范围的确定和整个警察法律体系能否合理建构。通过比较分析可以发现我国现行《警察法》的法律性质定位不清晰,且其内容规定与其法律性质定位不相匹配。基于这些考虑,我国未来《警察法》的完善应当在《警察法》法律性质定位清晰的基础上展开。一方面,明确《警察法》组织法的地位,将警察组织地位的合法性来源及其组织架构、职权范围、警察人员的权利、义务等内容给予明确的规定;另一方面,如果给予《警察法》行为法的地位,则需要规定警察职权行使的一般原则及其所特有的行为方式与行为规范。The nature of police law is involved in amending and perfecting police law,in confirming the scope that police law regulates,in constructing the system of police law.By comparative analysis,it is found there are some problems in the present people＇s Republic of China police law.These problems are that the nature location of the present people＇s Republic of China police law isn＇t clear and the regulation don＇t match with the nature location.To overcome the above—mentioned problems,the perfection of the present People＇s Republic of China police law should be based upon the clear orientation of its law nature.On the one hand,as it is defined as organization law,it should regulate the source of legitimacy of the police organization,the organization construction,terms of reference and the rights and duties of the police officer.On the other hand,as it is defined as behavior law,it should regulate basic principles that guide the police to exercise their powers and the particulate behavior ways and behavior regulation.
