信访制度的现实处境与改革方向:制度传统和现实需求视角下的分析

摘　　要：信访制度在被赋予重要地位的同时又广受批评,面临着既重要又尴尬的现实处境。对这种处境可从群众路线和法治这两个制度传统间的关系及这两个传统各自与对信访制度的现实需求间的关系中寻求解释,即信访制度与至今仍被坚持的群众路线传统密切相连,且在当下仍具备回应民众现实需求的功能,但其实施中又存在大量与越来越被强调的现代法治理念相悖的现象;对原有传统的坚持与对新传统的强调并重,以及亟待回应的现实需求共同造就了信访制度上述处境。本文结合对既有信访制度改革主张与实践的讨论并基于以上分析给出了对信访制度改革的方向性思考。Xinfang system has been attracting criticism widely, while occupying an important place in Chinese national governance system. This ambivalent situation can be understood from the relationships and mechanisms between two institutional traditions of mass line and rule of law, and the demands for Xinfang system in reality Specifically, Xinfang system is, as yet, closely connected to the Party＇ s mass line tradition, and is useful in responding to people＇ s various appeals. However, the implementing process of Xinfang system has been largely regarded as contrary to the rule of law, a new tradition governance system. Equal attention being paid to sticking to attracting more and more importance in national the mass line tradition and emphasizing on the importance of rule of law, and combined with urgent realistic demands, jointly result in above ambivalence. Based on above explanations, the expected reforming orientation is discussed.
