摘 要:国家开发银行经过多年改革与转型的摸索,最终被明确定位为开发性金融机构,完成了由政策性银行向开发性银行的转变,同时也标志着我国真正意义上的开发性银行的诞生。我国开发性银行的成立区别于国外发达国家"立法先行"的创立模式,目前开发性银行的相关立法仍处于空白阶段。在我国金融业发展步入新常态,银行商业化改革以及向混业经营转变的大趋势下,开发性银行的稳健运营和进一步发展更加需要法律层面的规范与引导。我国应当立足于金融业的发展现状,通过立法模式的选择和具体立法内容的制定,促进我国开发性银行在"有法可依"的保障下规范运行、持续发展。After years of groping for revolutions and transformations, development banks have been finally positioned as development financing institutions, completing the transformation form policy banks to development banks and signifying the generation of true development banks in China. In China, the establishment of development banks is different from the pattern of "legislation coming first" in developed countries. Recently, legislation concerning development banks remains in an empty phase. The development of financing industry in China is stepping into the new normal stage. Under the general trend of bank commercialized revolution and mixed operation - oriented transformation,law- level standard and guidance are further needed for steady operation and further development of development banks. The paper suggested that issues of legislation concerning development bank should base on developing situation of the financial industry in China and facilitate standardized operation and sustainable development of China' s development banks under the guarantee of "law - to - abide - by" by selecting legislation model and formulating specific legislation content.
