摘　　要：战争赔偿，是侵略战争的发动者必须承担的法律责任，也是法律赋予战争受害者神圣的权利。本文回顾了中国民间20多年的对日索赔历程，分析了索赔艰难的原因，提出了打破僵局的一些设想和希望。特别对灾难深重的南京大屠杀幸存者的索赔过程，作了全面而深入的研究。War claims are legal liabilities that shall be assumed by invaders, and a right endowed by laws to war victims. Chinese WWII victims have gone a long and tough road claiming indemnity from Japan and most of their efforts were in vain due to political reasons. This paper looks back the previous 20 years of their efforts, discusses the reasons behind, and puts forward several thoughts and ideas that might break the deadlock. Specifically, the paper conducts a comprehensive and profound study in how survivors of Nanjing Massacre claim for indemnity.
