摘　　要：网络交易行为能够起到有效促进经济发展的作用,但也出现了许多由于交易行为失范而侵犯消费者合法权益的问题,一定程度上破坏了正常的网络交易秩序。要有效规制网络交易失范行为,就要完善相关行为规范的法律、制度建设;健全管理体制,加强监管执法力度,以强制方法有效规范交易行为;不断探索诚信交易意识的培养和行为引导的文化研究与教育对策,使得交易主体能主动树立起自我守法守德经营的意识。以刚柔相互结合的行为规范模式,能够有效规制网络交易经营者的失范行为,起到维护网络交易秩序,促进网络经济健康发展的目的。Internet transactions effectively promote economic development,but many misconducts in internet transactions infringe the legitimate rights and interests of consumers,which,to some extent,destroy the normal order of internet transactions.To effectively regulate the behaviors of internet transactions,it is necessary to improve the establishment of laws and regulations,strengthen management system,supervision and law enforcement,increase the awareness of tradingintegrity and the sense of self-abiding.With the combination of rigid and flexible behavior modes,it is useful to effectively regulate internet transaction operators,maintain transaction order and promote the healthy development of internet economy.
