摘 要:目前,我国尚未制定颁布民办高校产权管理的专门法规条例,相关内容散见于教育法律法规和其他法律法规条款中,主要体现在国家和地方两个层次。各地方政府在民办高校注册登记、办学许可证行政审批、举办者变更等方面强化过程管理,改革试点地区也出台系列举措完善产权管理。但是,也存在法人产权不完整、内部治理缺乏制衡、资产财务监管不力、融资渠道不畅等问题。今后,应当保持公益性价值导向,正确认识公益性和营利性的关系,完善协调性法律法规体系,修订相关法律法规;制定针对性配套制度,使产权管理的发展与经济领域改革相互衔接。Since 1980 s,laws and regulations of property rights management for private universities mainly have been reflected in national government level and local government level.Local governments have been exploring effective measures for property rights management,such as registration,school license,the change of organizers and classification registration,etc.However,there are some problems,such as imperfection of the school corporate property rights,the lack of power balance in the internal management mechanism,weakness of asset and finance supervision and the poor access to finance.In the future,public-based value orientation must be maintained;the relationship between nonprofit and for-profit should be understood correctly.The present law and regulations should be modified and improved,and a full and coordinate system of laws and regulations should be established so that property management and economic reformation can be linked up.
