摘　　要：档案守法包含两个方面的基本内容:一方面是档案行政管理机关守法,指的是各级档案行政管理机关不能滥用权力,在法律规定的职权范围内依照法定程序开展档案管理活动;另一方面是档案行政管理相对人守法,作为档案行政管理相对人的公民、机构法人和社会团体依照档案法律法规的规定行使权利并履行相关义务。目前档案守法存在的不足是:档案守法之困惑,无法可守;档案守法之尴尬,定位模糊、功能不清;档案守法之障碍,可操作性差,执行困难;档案守法之不足,衔接协调能力弱等。为解决上述问题,在修改《档案法》《档案法实施办法》时,进一步明确档案法律法规的行政法定位,使之成为调整档案社会关系的基本规范;普遍开展档案行政执法,积极探索行之有效的工作方式方法,总结出有推广价值的工作经验;搞好相关人才的培养工作,特别是档案行政管理人员的培训工作,为法治政府机关的建设注入新的活力。The archival lawbiding contains two basic elements： on the one hand, archives administrative departments should obey the law, which means that archives administrative departments at all levels should carry out management activities within the scope of functions and powers as prescribed by the law in ac- cordance with legal procedures instead of abusing the right. On the other hand, The archives administrative relative counterparts which include citizen, institutional and social groups should exercise their rights and perform the relevant obligations in accordance with the provisions of archives laws and regulations. The confuse in the archival lawbiding is that there was no law to obey and short of descriptions in function, operability in the file law, the abilities of implementation are also weak. In order to solve these problems, we should make further efforts to clarify the position of archives laws and regulations, making them basic norms to adjust the social relation of Archives, while changing the ＂People＇s Republic of China Archives Law＂ and the ＂People＇s Republic of China archives law implementation method＂; we should also carry out archives law enforcement generally, exploring effective way of working methods actively and summing up the experience in promoting value; It is also necessary to do well in the cultivation of reserve talents espe- cially the archives administrative personnel＇s training work, injecting new forces into the construction of government by law.
