摘　　要：邓小平自中共十一届三中全会以后,强调要把发扬民主健全法制作为党和国家坚定不移的方针,对社会主义民主法制建设的各个方面和领域,进行了较为全面的论述,形成了内容丰富系统的邓小平法制思想,成为邓小平理论的重要内容。自改革开放以来,中国特色社会主义法治发展道路的探索已经历了五个具有里程碑意义的发展阶段。这五个里程碑分别是1978年中共十一届三中全会的召开;1980年邓小平在中央政治局扩大会议上的讲话;1992年邓小平视察南方的谈话;1997年中共十五大依法治国方略的提出;2012年中共十八大以来开启的依法治国新征程,尤其是十八届四中全会关于全面推进依法治国的顶层设计。这五个里程碑和邓小平及其法制思想从理论逻辑上说均有密切的关系。全面推进依法治国,建设社会主义法治国家,以邓小平法制思想为指导,应体现在以下方面,坚持中国法治道路的民族特性,坚持理论上的超越与创新,坚持学习、借鉴与立足中国国情相结合,坚持立足中国法治建设的现实需要和实践基础。Since the Third Plenary Session of the llth CPC Central Committee, Deng Xiaoping had emphasized that the development of democracy and construction of legal system must become the Party and state policy in China. He had discussed various issues in all fields of socialist democracy and law and these discussions have become important content of the system of Deng Xiaoping＇ s legal thought. There have been five milestones in the development of social- ist rule of law with Chinese characteristics since the reform and opening-up： the Third Plenary Session of Eleventh Central Committee （ 1978 ） ; Deng Xiaoping＇ s speech at the enlarged meet- ing of the Political Bureau of the CPC Central Committee （1980） ; Deng Xiaoping＇ s Speeches during the Inspection Tour of Southern Provinces （1992） ; the strategy of ruling the country by law put forward at the 15th CPC National Congress （1997） ; and the New Journey towards the Rule of Law started after the 18th CPC National Congress, especially the top-level design aimed at promoting the rule by law put forward at the Fourth Plenary Session of the 18th CPC Central Committee. There are close theoretical and logical links between Deng Xiaoping＇ s legal thought and all these five milestones. To construct a socialist country under the rule of law under the guidance of Deng Xiaoping＇ s legal thought, China must adhere to the national characteristics of the road toward the rule of law, the transcendence and innovation in legal theory, the strategy of drawing on useful foreign experiences while proc the method of basing itself on practical needs and in China. eeding from national condition in China, and the practice base of construction of rule of law
