摘　　要：作为国家的根本法,宪法始终面临着创建民主体制、维护民主制度、确保民主效果的任务。释义学无力回应民主制度的建构性功能与宪法发挥效力的全部过程。宪法设计民主制度,并控制民主过程。宪法工程将宪法视作一台机器,可以进行设计。何种民主?如何实现?这是宪法工程的任务。它不强调宪法作为需要进行演绎推理的规范体系,而是分析其作为规则和程序的引导功能,以及作为动力机制的激励功能。宪法工程阐明宪法与民主的关系,沟通规范与现实。它凸显了实证宪法的存在空间和积极功能,推动了政治宪法学的领域扩张。运用宪法工程会带来民主宪法的复归。As the fundamental law, constitution devotes to building the democracy systems, maintaining the work of democracy and consolidating the democracy of the nation. The constitution hermeneutics has lots of difficulties in interpreting the democratic constitution. The disenchantment of constitution means that we should emphasis the effect of constitution, which is the way of positive. The constitutional engineering bases itself on the practices and takes the norms as rules and procedures so that we constitutional scholars would discover the functions of constitution in democracy and test the rationality of the institutions in the constitution. By doing this, we can bridge the norms and the reality, the constitutional law and the politics. The constitutional engineering gives us an idea of positive constitution, and expands the area of political constitution. We can benefit from the concept and toolkit of constitutional engineering, in the meantime, the methodology of constitutional law would promote the democracy of our country.
