摘 要:检察权是人民代表大会制度之下确立的一种既不同于行政权也不同于审判权并由专门机关实施的法律监督权。为了维持不同国家权力间的微妙平衡,人民检察院在对行政违法行为实施检察监督时,应当遵守独立性原则、法定原则、协调性与必要性原则、谦抑性原则和争取其他国家机关配合的原则。据此,人民检察院在对行政执法活动进行检察监督时,应谨守检察权的边界,注意防止检察权过分干涉甚至代替行政权和其它监督权;检察监督的重点应限于百姓反映强烈的行政执法领域,以及严重损害公共利益的违法行政规定或具体行政行为;检察监督程序的启动应当符合公益性要件以及前置程序要件;检察监督决定的方式以及检察监督决定的效力应由法律加以规定。Different from either executive power or judicial power, prosecutorial power belongsto the power of legal supervision, established under the system of people's congress and implemented by a specialized organ. In order to maintain the delicate balance between different state powers, the people's procuratorate should abide by the principle of independence, legality, coordination and necessity, modesty and striving for cooperation from other state organs while conducting prosecutorial supervision. Hence, the people's procuratorate should not get beyond the boundary of prosecutorial power, and try to avoid excessive interference of prosecutorial power and replacement for executive power and other supervision powers. The emphasis of prosecutorial supervision should be restricted to the executive law enforcement field to which the masses have a strong reaction as well as illegal administrative normative documents or specific administrative acts which may cause serious damage to public interests. The prosecutorial supervision procedure should be initiated according to the important condition of public welfare and preceding procedures. The means and effect of prosecutorial supervision should be stipulated by the law.
