摘 要:法治从来都不是一种静态的纸面规则,而需要同时建立能动的运行机制。官员权力考评是着眼于国家权力运行动态监督制约的一种制度设计,其宗旨在于推动权力治理的法治化,进而最终实现国家法治。官员权力考评基于官员权力的法定性、可考评性以及人民监督的正当性,其方法是将官员的权力运行行为作为考核评价的客体,通过一套法定的方式方法,对其开展常态化的评估与评价,以期及时发现和纠正权力运行中的违法行为。考评官员权力是依法治国的必然要求,是预防权力腐败的迫切要求,也是现行官员考评制度完善的内在要求。Nomocracy(rule of law) has always meant more than static rules on paper. It requires the building of a dynamic mechanism. The evaluation of officials' power, with an aim to supervise and restrict the dynamic operation of state power, is a kind of system design. It aims to promote the legalization of power management and thus realize Nomocracy. The evaluation of officials' power is based on the legality and assessability of officials' power as well as on the legitimacy(rightfulness)of people's supervision. The way of evaluation is to take the power behavior of officials as the object to be assessed and evaluated by a set of statutory rules on a routine basis, so as to promptly identify and correct any illegal behavior in the power operation. The evaluation of officials' power is the inevitable requirement of the rule of law, and it is an urgent request for the prevention of power corruptions. It is also the internal need for perfection of the current evaluation system of officials' power.
