摘　　要：本文从专利申请文件的修改出发,结合专利实审过程中修改超范围的问题,阐述了运用法律思维去解决修改是否超范围问题的方法,并体现出在没有明确的尺度和规则去判断超范围的情况下,在面对问题时,从多个角度寻找有力的证据和理由,形成完整的逻辑并得出结论正是运用法律思维解决问题的具体步骤。Combining with the problems discovered in the process of patent substantive examination, this paper de-scribes the method of solving the problem of amendment beyond the scope of disclosure contained. This paper futher describes specific steps, including looking for evidence of amendment, and drawing a logical conclusion when facing a case with no clear criterion to judge.
