临床实习所涉医疗纠纷案件实例研究

摘　　要：[目的]分析临床实习当中所涉医疗纠纷案件概况,为防范此类纠纷的发生提供参考。[方法]以中国裁判文书网为资料来源,检索出相关案例,并对案例发生的原因进行分析。[结果]裁判文书网公布的符合纳入标准的案件共计77例,以2014年、2015年、2016年发生案件数较多,分别为24、35、8例,其他年份较少。全部案件中患方起诉理由均涉及实习医师非法行医这一点,审判结果认为带教教师及实习医师大多存在过错或不足。[结论]案件数量呈现逐年递增趋势,应进一步完善医学教育临床实践管理,保障临床实践在医学教育中的人才培养功能的实现,促进医学高等教育在法律的框架下健康有序的发展。Objective To analyze general situation of medical disputes involved in clinical practice so as to provide reference for keeping awaythis type of medical disputes. Methods Searched related cases based on the data source from judgement document net, and analyzed happenedcause of cases. Results There were 77 cases which met the inclusion criteria of judgement document net publishing. More cases happened in2014, 2015 and 2016, there were 24, 35 and 8 cases respectively. All the cases of patients prosecution that were related to practice doctors ofillegal medicine practice. Judgement result showed that mistake and shortage existed in teaching doctors and practice doctors. ConclusionsNumber of cases are increasing year by year. The management of clinical practice of medical education should be further perfected, and thefunction of clinical training in medical education should be ensured, so as to promote the development of medical higher education in a healthyand orderly way under the framework of law.
