摘  要:在现有的国际经济法范围内,国有企业的反竞争行为在不同立法框架下受到约束。在美国的主导下,《跨太平洋伙伴关系协定》(TPP)首次围绕国有企业本身设置横向议题并完成了谈判。新谈判的规则对中国国有企业而言具有较强的针对性,诸多现有做法受到约束和调整,但国企改革的整体方向与其是一致的。为此,中国应积极面对国企规则的新发展,以推动国企进一步改革为核心,辅之以在国际层面倡议国企运行的多元化评价体系、在双边和区域层面试水国企规则谈判,加强国有企业国际规则的法学研究,探索国际层面规范国有企业应树立的恰当边界。Under the current international economic law system, the State-owned Enterprises may receive regulation from varied rules such as the anti-dumping rules, the countervailing rules, the competition rules and etc. As pushed by the United States, TPP firstly set down a special State-owned Enterprises Chapter. The new negotiated rules strongly against China and put great pressure to many of our current practice, however, they are not conflict with the direction of China's reform of state-owned enterprises. Therefore, China should react the TPP state-owned enterprises rules positively, i.e., we should fin-ther push the reform of state-owned enterprises, propose diversified evaluation system of state-owned enterprises at the international level, and enhance research on the specific rules to explore the proprioate boundary of the international State-owned Enterprises.
