关于警察权力制约的几点思考

摘　　要：警察权作为国家权力体系的重要组成部分,在国家权力的运转过程中发挥着至关重要的作用。而警察权的滥用,会直接造成对行政相对人合法权益的侵害。如何制约警察权力,让警察权在合法、合理的状态下运行,就变得非常重要。本文拟从权力、权利和道德三个方面来分析警察权力的制约,以期避免警察公权力的行使侵犯公民的权利,真正发挥警察的社会公共职能。As the key part of the state power,police power has always been playing important role social governance, however,the abuseness of police power will make harm to administrative counterpart, how to check and balance it is become more important, this article analyze the check and balance for police power on the basis of power, right and morality, and hopes to avoid violating the citizen＇s rights from police power and to make police power run lawfully.
