被害人视域中的传播性病罪

摘　　要：从被害人视角考察,我国《刑法》中传播性病罪的立法目的是为了维护社会管理秩序,然而性病的广泛传播现实与此目的发生了脱离。不仅如此,司法实践中对传播性病罪的适用也与现实境况出现倒挂现象。同样,被害人信条学在传播性病罪中也没有发挥出其目的论的缩限功能。因此,针对传播性病罪而言,我们应当将其立法目的回归为对被害人生命健康权益的保护,摒弃无视被害人的法律家长主义的传统思维,从而对我国《刑法》第360条予以重新建构。The legislative intent of the crime of spreading venereal diseases in China＇s Criminal Law is to maintainthe social management orderfrom the perspective of victims, while the wide spread of venereal diseases in reality has deviated from it. Moreover, the inversion phenomenon has appeared when applied the crime of spreading venereal diseasesin juridical practice compared with the reality. At the same time, the dogmatik of victims hasn ＇t function correctly in its teleologische Reduktion. As a consequence, in terms of the crime of spreading venereal diseases, we should regress the legislative intent to protect the victims right of life and the right to health, abandon traditional thinking mode of legal paternalism which ignores the victims, and reconstruct the article 360 of our criminal law.
