摘　　要：根据不同的判断标准,政府指导价制定行为既可能是具体行政行为,又可能是一种抽象行政行为。政府指导价行为是具有双重法律效果的行政行为,是依职权的行政行为,其与行政指导行为截然不同。政府指导价是对市场进行合理干预的一种重要手段,其理论基础是政府规制以及公共利益维护。政府指导价的适用范围应当进行调整。政府指导价行为是否具有可诉性以及原告资格问题应当根据不同情况而作区别对待。Government guided-price behavior is a specific administrative act or administrative action abstract. Government guided-price behavior is in accordance with the terms of reference of the administrative act. It has a dual legal effect of administrative acts. It is very different with the administrative guidance. Government guided-price is a reasonable market intervention. Theoretical Foundation of government guided-price is government regulation and public interests protected. The scope of government guided-price behavior should be adjusted accordingly. The legal remedies and for Government guided-price behavior and its litigation plaintiff should be determined according to the specific circumstances.
