我国绿色专利加速审查制度的改进研究

摘　　要：[目的/意义]大力发展绿色技术是解决能源问题和环境污染问题的必然选择,也是产业结构升级和经济发展转型的必经之路。为促进绿色技术创新与应用,提高我国在绿色技术上的国际竞争力,建立和完善我国绿色专利加速审查制度具有重要的现实意义。[方法/过程]在对比分析几个发达国家绿色专利加速审查制度的基础上,再结合我国实际,归纳总结,探讨如何改进我国绿色专利的加速审查制度。[结果/结论]明确的审查标准、严格的审查程序和权威的法律保障是成熟绿色专利加速审查制度必备的三要素。因此,从这三个要素出发,对改进我国绿色专利加速审查制度提出了几点建议。[ Purpose/Significance] Developing green U^hnology not only is the inevitable choice for solving energy and environmental problems, but it is also the essential way for upgrading of industrial structure and transforming of economic development. The establish- ment and improvement of accelerated green patent examination system has great practical significance for promoting green technology inno- vation and application, and enhancing the international competitiveness in green technology. [ Method/Process] In this paper, the im- provement of our accelerated green patent examination system was investigated based on the analysis of developed countries＂ accelerated green patent examination system and our national condition. ~ Result/Conclusion ] The mature accelerated green patent examination system has three aspects of explicit examination criteria, rigorous examination procedures and authoritative legal protection, and hence some de- tailed suggestions for improvement were given in those three aspects.
