从“自利”到“自制”:村级治理规避“分利秩序”的机制分析——以上海市若干近郊村为考察对象

摘　　要：在利益密集型村庄,"分利秩序"成为瓦解村级基层组织合法性的关键变量,探讨如何规避"分利秩序"的问题便具有政策研究意义。本文以上海市若干近郊村为研究对象,通过对近郊村村级基层组织现状的考察,发现村级基层组织在三个层面发生改组:第一,村干部通过内部分工与分层完成"双重角色"的分离;第二,通过调整村级组织的内部权力结构以实现权力的集权化;第三,通过"嵌入式"镇管村体制将村级权力运作的外部监督制度化。村级治理在权力主体、权力结构和镇村关系三个层面的变化重塑了村干部的行为逻辑,村干部由"结构性自利"转变为"结构性自制",从而实现对"分利秩序"的规避,为利益密集型村庄走出村治困境提供了新的经验与路径。In the interest-intensive village and the benefiting order are the key variables to disintegrate the legitimacy of village grassrootsorganization.Therefore the discussion of how to avoid the benefiting order is of vital significance.This paper took several suburban villages of H city as the research objectsbased on the investigation of the present situation of the suburban village grassroots organization,and find that the village governance structure is reorganized in three aspects.First,through internal division and internal layering to complete the separation of the dual role of the village cadres.Second,by adjusting the internal power structure of village organization to realize the centralization of power.Third,the external supervision of power operation should be institutionalized through the embedded county-village management system.The village governance changeson three aspects,including power of main body,power of structure and county-village management system to reshape the village cadres'behavior logic.So the action logic of village cadres changesfrom the structural self-interest to structural self-control and it can avoid the benefiting order.The research in the paper provides new experience and path for the interests-intensive village to get out of the village governance's dilemma.
