摘 要:农民集体土地征收补偿制度中,市场价格标准的正当性在于回归私权的调整方式。由于现行市场补偿标准的行政确定方式、协商方式、第三方裁决与评估方式在我国现行制度条件下存在着不同形式的制度成本,采用征地补偿请求权入股的补偿形式具有制度优势。在具体的制度设计上,根据地方立法样本,征收补偿权股权化的制度安排应区分生存权利益保障和财产权利风险控制两个层次,设计补偿请求权入股的具体规则。In the land acquisition compensation system of peasant collective , the legitimacy of the standard market price adjustment method is to return to private rights.
