仪式炫耀、功能检视与规制应对——论黑社会性质组织的符号化样态及其治理启示

摘　　要：在国家保持高压打击态势的背景下,黑社会性质组织出现了采用"劣迹化"身份、"脸谱化"形象、"模式化"举止和"表演化"仪式等符号化样态以取代传统暴力特征的演进。符号化样态的运用,具有对内黏合成员的整合功能、对外塑造实力的威慑功能,以及降低刑事惩治风险的规避功能。就刑事治理而言,首先,在刑事立法层面,可考虑以"黑社会组织"一词统一指称涉黑犯罪组织,并将符号化样态纳入黑社会组织认定标准作为近期方案,将择机制定《反黑社会组织法》作为远期方案。其次,在刑事司法层面应摒弃黑社会组织必须具有暴力性的狭隘认识,对采取符号化样态的黑社会性质组织依法适用刑罚。Under the pressure of the state,the underworld organization evolves by appearing as ＂misdeeds＂identity,＂facial makeup＂image,＂symbol mode＂and＂performing＂manners.Symbolic form can realize the integration function of the adhesive members,display the strength of organization,and avoid the risk of criminal punishment.To respond to that new trend,first of all,in the criminal legislation,we can consider the word ＂underworld organization＂as a unified alleged organized crime gangs as a recent program;and make‘anti-triad organization law ＇as a long-term plan.Secondly,in the criminal judicature,we should abandon the narrow viewpoint,which claims that underworld organization must have violence,and such underworld organization should also be applicable to the penalty according to the criminal law.
