陕西传统文化产业发展中的版权保护研究  

On the Copyright Protection in Shaanxi's Traditional Culture Industry:From the Perspective of Copyright Protection in Dehua's Ceramics Industry

摘　　要：版权制度既保护传统文化产业中的创新因素,促进权利人创新,又将传统元素保留在公共领域,保存了传统文化产业发展的土壤,契合了传统文化产业的发展需求。因此,陕西应当充分利用版权制度,推广版权登记,降低版权维权成本,让版权制度更为广泛地被当事主体运用,从而保护创新,促进传统文化产业发展。Shaanxi has huge potential in traditional culture industry, but the ability of innovation still needs to be raised. Copyright institution protects the innovative parts so as to stimulate the right holders to innovate and it also retains the traditional parts in the public domain so as to save the basis for the development of traditional culture industry, which meets the requirements of the development of traditional culture industry. Therefore, Shaanxi should make use of copyright institution to develop traditional culture industry. But Shaanxi has some problems in that, so Shaanxi needs to apply Dehua＇s experience on developing ceramics industry by copyright institution. In detail, the experience is promoting copyright registration and reducing the cost of protecting copyrights, through which the copyright institution can be used more broadly. As a result, innovation can be protected and traditional culture industry can be promoted.
