摘　　要：通过对自甘风险规则发展状况的梳理,展示其从产生、鼎盛、式微的发展现状。说明在我国现有法律框架下明示的自甘风险可由"约定的责任限制"替代,主要的默示自甘风险实为运动场上的意外事件处理原则,次要的默示自甘风险能由现有侵权法则解决,自甘风险规则在历史的发展中已无存在的必要。The analysis of different development phases of the rule of assumption of risk showed that under the present legal system,the assumption of risk can be substituted with＂the Convention on Limitation of Liability＂.The major implied assumption of risk is practically the treatment of accidents on the sports field,while the minor implied assumption of risk can be settled by regulations of the existing Tort Law.Therefore,there is no need to have rule of assumption of risk.
