宏观调控中信赖利益保护的法律制度设计研究

摘　　要：宏观调控是政府通过制定政策影响微观经济行为以促进经济平稳发展的决策过程。通过建立信赖保护机制,为控制宏观调控权提供了新颖的法律制度构建思路。在宏观调控中以信赖保护的构成要件为奠基的前提下,对信赖利益进行真实性保障、合理期间、比例性、事先通知四方面的事前控制,设置过渡期、不朔及既往的事中保护,存续保护、财产保护进行的事后救济,全方位多层次构建完整的控制宏观调控权的信赖保护制度,以期在保障社会公平的同时促进宏观调控目标的实现。Macro-economic control the micro economy through making ideas of constructing legal system up protection system of reliance is a decision-making process handled by the government to influence policies to promote the steady development of the economy. Innovative are offered to control the macro-economic control rights through interests. It is proposed that a complete protection system of building reliance interests of macro-economic control fights be constructed in comprehensive and multi-level ways taking the components of protection of reliance interests of macro-economic control as premises, making feed forward control for the reliance interests in chronological order from such four aspects as authenticity guaranty, reasonable period of time, proportionality and prior notice; establishing protection inwards of transitional period and non-retroactivity; providing relief afterwards through the continuity protection and the asset protection, hoping to ensure the social equality as well as the realization of the aim of macro-economic control.
