奥运会参赛运动员若干权利问题研究

摘　　要：采用文献资料、逻辑分析等研究方法,对奥运会参赛运动员所享有的主要权利进行了厘清。分析体育权利、奥林匹克运动的纲领性文件《奥林匹克宪章》(2014)以及《体育运动国际宪章》等国际体育规章的基础上,对奥运会参赛运动员的平等和不受歧视权、身体健康权、公平竞争权、教育权与职业保障权、建议权进行了较为详细的阐述,并从奥林匹克运动中的年龄限制、裁判行为、金牌追求的"异化"行为、经济与合同行为4个方面探讨了奥林匹克实践中侵害运动员权利的现象,并提出了通过修订相关规范性文件明确运动员的基本权利、采用先进的技术性设备和严密的程序保证裁判工作的公平与公正、进一步落实"运动员职业发展计划"中的核心要旨、建立完善的利益协调机制保障运动员权利的建议。This article aims to analyze the main rights of athletes participating in the Olympic Games, by u- sing the research methods of literature consultation and logic analysis. On the basis of the analysis of sports right, the Olympic Charter, the International Charter of Physical Education and Sport, this article illustrates the main rights of the Olympic athletes, concerning equality and non - discrimination, health, fair play, educa- tion, professional guarantee, participating in decision- making. The article also diseusses the phenomenon of encroaching on the rights and interests of athletes in the aspects of equality and non- discrimination, referee, decision, the alienation in the pursuit of golden medal and contract. The article makes some tentative sugges- tions on protection of the rights and interests of athletes ： revise related normative documents to clarify athlete＇s basic rights, adopt advanced technology and stringent procedure to ensure referee,s decision fair, implement the core essence of Athlete Career Programme further, establish perfect interest coordination mechanism to guaran- tee athlete,s fights.
