Local governments' powers and responsibilities in protecting agro-product geographical indications

摘　　要：在现有法律框架下,地方政府拥有对地理标志申请进行资格确认、对产地范围提出建议、对农产品地理标志进行监督管理的权力,承担制定政策、提供资金支持的职责。地方政府的上述权力及职责还需要从以下方面加以细化:建立农产品地理标志统筹协调机制;严格、审慎行使申报者资格认定权及产地范围建议权;对农业生态的保护进行合理引导;建立公平的利益分配机制,帮助农户维护合法权益;整合社会资源,增加地理标志农产品的产品项目等。According to the laws, loeal governments have the power of identifying the applying qualification of geographieal indication, putting forward suggestions for regions, supervising and management, and have the responsibilities of formulating policies and providing funding support. The powers and responsibilities of local governments also need to detail from the following aspects： first, establishing the coordination meehanism of agrieuhural products＇ geographical indications; second, strictly and carefully exercising the right to declare qualified applicants and the fight to suggest the seope of origin ; third, reasonably guiding agrieuhural ecological protection; fourth, establishing a fair benefit distribution mechanism to help farmers to maintain the legitimate rights and interests; fifth, integrating social resources and increasing product items of agricultural product geographical indications.
