民法典总则编与亲属编的关系问题——以法律行为与身份行为的关系为视角

摘　　要：探讨总则编与亲属编的关系问题是很有必要的,因为在学术界,对于总则编的规定能否适用于亲属编的问题一直存在不同看法,而其争议的实质是法律行为制度在亲属编的适用问题。法律行为制度在亲属编是可以适用的,但由于财产行为与身份行为的差异,在总则编中应对这两种行为分别做出规定。在"讲法理、讲体系"新的指导思想之下编纂民法典,亲属编作为其中的一编,在总则编一般规定的基础上,关于身份行为的规定既要注意身份行为的特殊性,又要注意与法律行为的相关性,处理好一般与特殊的关系,同时保持与总则规定相互间的协调。在亲属编回归民法的现实背景下,涉及身份行为的解释,应该根据民法学的原理,通过民法制度的构造进行诠释,以保持与民法学解释体系的统一。The circle of marriage law in China has been involved in the draft of the family chapter（also known as marriage and family chapter） of China＇s future Civil Code. Therefore, it is necessary to discuss the relationship between general provisions and family chapter of the Civil Code. In the academic circle, there are different views about whether the general provisions can be applied into family chapter. The substance of the dispute is the application of the juristic acts in the family law. The juristic acts can be applied in the family law, but due to the differences between property acts and identity acts, the two should be explained and regulated in the general provisions. With the new compilation guidance of ＂paying attention to legal principle and system＂, the draft of family chapter, basing on the general principles, should pay attention to the special characteristics of identity acts and the relevance to the legal acts when regulating about identity acts so as to maintain coordination and consistence with the general provisions. Under the background of the return of family chapter in the Civil Code, the interpretation of identity acts should be based on the principles of civil law so as to maintain the consistence with the interpretation system of the civil law.
