摘　　要：缺陷产品民事侵权责任对召回行政监管具有支持性,对召回行政责任具有补充性。民事侵权责任体系的完善,有助于产品安全社会监督的实现,符合行政改革简政放权、社会共治的原则。民事侵权责任体系中的惩罚性赔偿制度援引至英美法系,在我国民法制度中尚处于理论研究和初步试验中。本文将对产品侵权民事责任体系的完善,以及缺陷产品民事侵权惩罚性赔偿的法理研究、制度设计提出相关建议。Civil tort liability of defect product can support recall administrative regulation, also complement the administrative responsibility of recall. The perfection of civil tort liability system helps the realization of social supervision of product safety, co.nforms to the principle of administrative reform and decentralization, social collegiality. The punitive compensation responsibility in civil tort liability system citing to the Anglo-American law system, is still in the theoretical research and preliminary experiment in Chinese law system, this article gives some suggestions to complete the defect product civil tort liability system, theoretical research and system design of punitive compensation responsibility.
