摘　　要：擅自侵入铁路线路行为中,擅自侵入者通常不具有合法性和正当性,但由于法律规制的不足,擅自侵入者没有承担与之过错或者危险程度相适应的责任。在阐述擅自侵线行为的认定与法律适用的基础上,对擅自侵线行为的法律规制现状进行评析,提出擅自侵线行为阶梯化法律规制的完善建议,即民事责任部分应体现民事主体地位的平等性、消除行政处罚中法律适用的冲突、在刑事责任的规定上应完善附属刑法的规定,以在铁路法律体系中构建完善合理的责任体系,增强法律的指引和规范作用,保障铁路运输安全。In the action of intruding railway line without permission, the intruder is generally illegal and wrongful. However, because of insufficient legal regulation, the intruder does not assume responsibilities for his relative wrongs and the dangers he has generated. On the basis of expounding the recognition and law application of the action of intruding railway line, this paper evaluates the legal regulation status of the action, and puts forward improvement suggestions on ladder-like legal regulations of the action, such as the civil liabilities should reflect the position equality of civil subject, to eliminate the conflict of law application in administrative penalty and to improve the rules of accessory criminal law, so as to establish improved and reasonable responsibility system in railway law system, strengthen the law＇s introduction and normative roles and ensure railway transport safety.
