网约出租车的产业技术经济特征与公共管制

摘　　要：对比分析了巡游出租车与网约出租车的产业技术经济特征,说明按照管制巡游出租车的理由和方式管制网约出租车是不合理的;分析了网约出租车管制机构与司机、经营者与司机的信息不对称问题,解释了放开市场准入、放开数量和车型价格直接管制的机理,提出管制的内容和方式在于依法通过平台管制经营行为、按照契约仲裁交易纠纷;研究了网约平台运营和出租车运营纵向一体化和分离两种组织模式的运作特征和管制政策选择;分析了平台经营与出租车经营的专业化分工合作方式及其契约关系,得出把出租车经营者作为实际承运人符合现行法规和更具可操作性的结论 ;讨论了对网约平台和出租车经营者经营行为的管制方式和策略。In this paper we analyze the technical and economic characteristics of the parade taxi and internet ordered taxi and states that it is not proper to regulate the internet ordered taxi by the reasons and methods used for the parade taxi; analyze the problem of information asymmetry between the internet ordered taxi regulatory agencies and drivers, and between operators and drivers; explain the mechanism of liberalizing the direct regulation of market access permission, taxi quantity and the type and price of taxi. In this paper we proposes that the regulation content and method should relay on the lawful platform to regulation the operation activities and, follow the contract arbitration to solve the trade disputes and research on the operation characteristics and organizational control policy of two organizational modes, the vertical integration and separation of internet ordered platform operation and taxi operation; points out the solution that it is more lawful and practicable that taking the taxi operators as the actual carrier based on the analysis of the specialized division and contractual relationship between platform operator and taxi operator. There is also a discussion about the regulation methods and strategies of operation behavior of platform operator and taxi operator.
