摘　　要：碳金融为应对气候变化而推进温室气体减排提供资金支持,在国内外均呈现蓬勃发展之势。碳排放权是碳金融体系的基础,其意为权利人对碳配额或碳信用所表征的容许碳排放量进行占有、使用、收益和处分的财产权利,此应在立法中明确。立法还应明确碳金融的监管主体及其市场准入监管权、信息披露监管权、调查取证权、违规处罚权等监管权限,为维护碳金融市场秩序提供有效保障。The carbon finance activities give financial support to the carbon emission reduction to combat climate change and develop fast in the world. The carbon emission right is the basis of carbon finance and it is the obligee＇s property right to occupy, use, profit from and sell ＂allowable carbon emission volume＂. The legislation should provide the regulator of carbon finance activities and its power on the market access, information disclosure, investigation, and penalty, in order to maintain the carbon financial market order.
