摘  要:政府和社会合作模式具有双重面向。一方面,它被视为公共服务提供方式的一种制度性革命,它包含了政府选择合适的社会资本主体,并与之合作共同分担风险、分享收益的公共服务的全过程,因此被纳入公共采购法的范畴。另一方面,推广PPP模式的领域集中于基础设施和公共服务,又属于行业规制法的调整对象。随着政府和社会合作模式的引入,政府职能需要从公共服务的提供者转变为公共服务的采购者和规制者。要保证其成功实施,一方面需要完善公共采购法规制,以保证选定合格的社会资本合作方来提供公共服务并且实现物有所值;另一方面也需要通过选择适用标准制定、价格规制等规制工具确保公共服务提供责任发生转移之后,依然担保社会资本所提供的公共服务能够符合公共利益的需要。Public-private Partnership is double-faceted. On the one hand, it is seen as an innovative mechanism of public service provision, which includes the whole process from selection of the right private partners to cooperating and sharing risks and benefits in service provision. Thus it is widely integrated into the scope of public procurement law. On the other hand, Public- private Partnership is mostly used in infrastructure and public service projects which are subject to industrial regulatory law. With the introduction of Public-private Partnerships, the function of government has evolved from provider of public services to buyer and regulator of public services. In order to succeed, not only public procurement laws should be improved to secure competent private partners to deliver service and maximize value for money, but also proper selection of reg- ulatory tools such as standard setting and rate making should be made to ensure the provision of public services to service the public interest after the responsibility of public service provision is transferred to the private partners.
