陈氏太极拳知识产权保护问题考察

摘　　要：运用文献、实地考察、质性访谈和案例分析等方法,从法律以及非物质文化遗产的角度对陈氏太极拳知识产权保护问题进行分析。结论:第一,从著作权法的角度考察,只有当陈氏太极拳身体技术的表演性占主导地位时,在法理上才可以与舞蹈与杂技一样成为著作权意义上的作品受到法律的保护。在此前提之下,陈氏太极拳无论作为法律意义上的演绎作品、汇编作品还是职务作品,都无法准确找到与其对应的主体。第二,对于陈氏太极拳相关名称如"陈氏太极拳""陈家沟"以及"陈小旺""陈正雷""王西安""朱天才"的商标权,现今的《商标权法》对以上名称的运用都可以加以规范,但必须依靠其他法律如民法才能较全面的进行保护。第三,针对现今陈氏太极拳身体技术动作多元化发展而表现出的"失真"的现象,从非物质文化遗产的角度考察陈氏太极拳的知识产权保护必须强调其"真实性"。The study on intellectual property protection of Chen style Tai Chi with literature, field survey, qualitative interviews and case studies from the perspective of laws and non-material cultur- al heritage as follows ： First, from the perspective of Copyright Law, if the performance in body tech- nology of Chen style Tai Chi makes a dominant position, it can be protected by the law like the ma- terial of copyright such as dance and acrobatics. In this context, it is unable to find the main coun- terpart accurately no matter as Chen style Tai Chi a legal sense of derivative works, compilation works and works for hire. Second, for the related names of trademark in Chen style Tai Chi such as ＂Chen style Tai Chi Chengjiagou Chen Xiaowang Chen Zhenglei Wang Xian＂ and ＂Zhu Tiancai＂, the ＂law of trademark＂ can be regulated these names but limited. It must rely on other laws such as civil law to undertake more comprehensive protection. Third, the movements of Chen style Tai Chi towards diversified development and shows ＂distortion＂ phenomenon, so the intellectu- al property protection of Chen style Tai Chi must emphasized the ＂authenticity＂ from the perspective of non-material cultural heritage.
