摘　　要：随着近年来司法鉴定业务量的快速增长,对鉴定活动或鉴定结果产生质疑、不满进而对鉴定人进行投诉、攻击以及到鉴定机构谩骂、闹事等行为相应增多,基于对该类纠纷产生缘由的分析,建议立法者可采取赋予当事人鉴定过程的程序性参与权、能够直接启动重新鉴定的救济权,以及设立全国统一的鉴定人资格考试等措施予以应对。In recent years, along with the rapid increase in the number ot juu^c~al ~＇t＂ ~ including querying the expertise procedures and results, showing dissatisfaction, complaining, attacking and even scolding or rioting the expertise organs, are increasing. Based on an analysis of the causes of these acts, the author suggests legislators consider giving the party concerned the right of participation in expertise procedure and the right of remedy of restarting another expertise, and setting up a national qualification test for appraisers.
