论我国律师在场权制度的构建

摘　　要：文章着重分析了我国引进律师在场权制度的现实可能性,并得出我国应采用渐进的方式建立律师在场权制度的结论。最后,从适用界限、权利告知、行使方式、在场律师的权利与义务等方面讨论了构建我国刑事侦查阶段律师在场权制度的具体措施,并指出应当完善法律援助制度,建立律师豁免制度,以保障律师在场权制度的良性运行。This article analyzes the possibility of China＇s introduction of lawyer presence right system,and makes a conclusion that China should establish the presence right of lawyer system in a gradual approach.Finally,the article discusses specific measures to establish lawyer＇s presence right system in criminal investigation stagefrom the applicable limits, the right to inform, to exercise the way, the lawyer＇s rights and obligations and so on.In addition, it also points out that we should improve the legal aid system, the establishment of the exemption systemto ensure the benign operation of lawyer＇s presence right system.
