摘 要:随着土地市场配置机制的建立,土地征收制度改革一度成为统一城乡建设用地二元制度中的焦点话题。征地启动的前提,征地补偿的标准,补偿方式的创新等,是关乎这项改革整体走向的主要议题。辨析这些改革内容的合法性,杜绝一些矫枉过正的改革措施,对正确把握土地征收制度的改革方向,构建具有特色的土地征收法律制度的理论和制度体系,具有重大意义。特定土地征收制度必然与其土地权利体系相适应,我国土地征收制度的改革方向,应当建立在以具有独立物权性质的土地使用权为核心的基础上。With the establishment of the land market allocation mechanisms, The reform of land expropriation system has become the focus in the process of unifying urban and rural construction land system, the main issue that concerns the overall trend of the reform is the premise, the compensation standard and the innovation of compensation mode for land expropriation. Analyses the legitimacy of the contents of these reform, put an end to some overkill reform measures, is of great significance for grasp the correct direction of the land expropriation reform system, and for construct the theoretical and institutional system of land expropriation. The specific land expropriation must be adopted to specific rights system of land. The reform direction of China's land expropriation system should be based on the land use right, which is independent as a property right.
