行政应急管理的规制与基层治理的实现——反思乌坎事件

摘　　要：反观乌坎事件可以发现,行政应急管理虽暂时平息了乌坎事件,化解了因乡村社会内部矛盾引发的社会冲突,但同时行政应急管理也为彻底解决乌坎问题增添了新的障碍。高位推动的处理方式消解了地方政府的权威;"闹大"的预期结果强化了民众超越乡村社会进行维权的路径和方法;"政府允诺"放大了民众对解决具体问题的期待和想象。这也表明具体问题的解决有赖于常规化的基层治理模式,乌坎事件的有效处理,需要在外力推动下,重塑常规基层治理的可能性,营造乡村社会的良好秩序。乡村社会秩序的生成,"必须再造中间层",即重新充实乡村基层政权,有效整合乡村社会内生资源并让其发挥应有的作用。一方面需要加强基层政权的治理能力,尽量避免采取"高位推动"的方式解决村庄问题;另一方面,也应该从制度上加强对基层政权行为的规范化,以便形成新的村级自治结构和社会基础。Reflection on Wukan event is helpful to reveal the fact that the administrative emergency management temporarily quelled Wukan event,resolved social conflicts among rural society.However,at the same time,the administrative emergency management created also obstacles for thoroughly solve the Wukan event.The intervention of senior government officials undermine the authority of the local government;the result of'all a bunch of pussies'strengthens the approaches of safeguarding rights through appeal beyond;'administrative promises'amplify the expectations and imagination of people on dealing with specific problem.Specific problem depends on the normalized mode of grassroots governance.Efficient handling on Wukan event need to reshape the normalized mode of grassroots governance and build good order in rural society with the help of outsider.The formation of the rural social order must'rebuild the middle class',namely to enrich the rural grass-roots regime,effectively integrate the indigenous resources of rural society and let it play a proper role.On the one hand,it should strengthen the ability of grassroots governance and try to avoid the intervention of senior government officials to solve the problem on the village level;on the other hand,it should strengthen the standardization of grassroots regime to form a new structure and social foundation of village autonomy.
