核安全监督中行政问责相关问题探讨

摘　　要：近年来政府工作人员经常被问责,核与辐射安全监督站作为核安全监督部门,尽管到目前为止尚未有人因事故/事件受到行政问责,但由于核事故的特殊性,如果在其监督范围内发生事故,核安全监督人员是否一定会被问责,什么情况下存在尽职免责的可能,如何做才能免责或减责。本文在对上述问题的法律法规依据、问责的前提和核安全监督的法定职责进行深入剖析的前提下,对核设施的安全责任与核设备制造的质量责任关系以及尽责免责和减责的问题进行了探讨。In recent years,it is very common that government staffs were held accountable.Regional office of nuclear and radiation safety inspection,as nuclear safety supervision department,though so far has not one been held accountable due to nuclear accident /incident,but if an accident within the scope of their supervision happened,whether the nuclear safety inspectors will be accountable？ And if the inspector has fulfilled his duty well,is it possible that he will not be held accountable after an accident/incident？ In this paper,above problems has been discussed based on the analysis of legal laws and regulations,the premise of accountability and the statutory duties of nuclear safety inspection.
