摘　　要：通过对已公开行政不作为复议决定的分析可以看出,行政复议机关审理行政不作为案件形成了有无作为义务、有无作为现实可能以及是否已经作为等判断标准。在被申请人不履行法定职责上,我国《行政复议法》第28条第2项规定中包括"不履行"和"拖延履行"两种类型;在行政不作为复议决定方式上,我国《行政复议法》及其《实施条例》规定了履行决定、确认决定和驳回复议申请决定三种方式。为及时、有效地解决行政争议,保护相对人的合法权益,在未来《行政复议法》修改时,应明确被申请人履行作为义务的具体内容,同时对行政复议决定类型进行科学合理的分类,从而更加有助于发挥行政复议在化解行政争议、监督行政机关依法行政方面的功能。The public administrative nonfeasance reconsideration decision analysis shows that the administrative reconsideration organ have formed without administrative inaction cases as a compulsory, whether as reality may be,and whether they have been as judgment standard.The administrative reconsideration law item（2） of article 28 of the respondent fails to perform the statutory duties includes ＂default＂ and ＂delay performance of＂ two types.In the mode of administrative nonfeasance decision of reconsideration,the administrative reconsideration law and its regulations on the implementation of provisions of the performance of the decision,confirm and three ways to reject the application for reconsideration decision.To timely and effectively solve the administrative dispute,the protection of legitimate rights and interests,the administrative reconsideration law modification in the future,should clear the specific content of as obligations by the applicant;will reject the application for reconsideration decision to dismiss the reconsideration request.Discussed about different ways of the administrative reconsideration decision,helps to play to the administrative reconsideration to resolve administrative dispute and supervision of administrative organs to the role of administration according to law.
