农村小产权房的区别性合法化相关法律问题探讨

摘  要:随着房价的逐渐抬高,农村的小产权房日益增多。而对小产权房的非法性的定性并没有有效抑制其交易日渐增多的趋势。为了维护社会的稳定并适应市场经济的发展,采取因时制宜的法律态度值得考虑:对向城镇居民销售小产权房持否定态度,对向除本集体经济组织以外的其他村集体成员销售小产权房持肯定态度。同时还应当关注由此带来的其他相关法律问题,比如向除本集体组织外的其他集体成员销售小产权房的物权公示、住房质量验收、安全保障等制度。With the houses price rising, the amount of rural small property room is increasing. But the property right of illegality is not effectively restrain the trend of trade increasing. In order to maintain the stability of the society and adapt to the development of market economy, take the attitude of act according to circumstances worth considering: for urban residents to have held a denial attitude to sales of small property room, to the village collective members in addition to collective economic organizations other than sales, we held a positive attitude to the small property room. Also we should focus on other related legal issues originated from this, such as selling small property right room to other group members except the collective organization sales right publication, the housing quality acceptance and security, etc.
