“我(不)想X/Y”法庭调解话语策略表达机制研究

摘　　要：法庭调解的过程是通过话语选择、表达调解诉求的话语博弈过程。文章基于真实法庭调解话语语料，重点探讨法庭调解过程中调解参与者是如何通过“我（不）想X／Y”调解机制来阐解话语意图、操控词语概念、游离纠纷事实与判断以及偏离话语角色等调解话语现象，揭示法庭调解中有悖于调解自主自愿、中立公正原则的调解话语策略，以期规范调解意图话语策略表达，推动调解朝着成功或撤诉、促进社会和谐方向发展。The whole court-related mediation process is a game-oriented process of discourse selection so as to achieve meditation purpose. Based on authentic court-related mediation discourse data, this paper takes I don＇t want X/Y as a case study, and explores how mediation participants exploit the court-related mediation discourse strategies to convey mediation intention, manipulate mediation utterance concepts, shift between dispute facts and deviate from the third-party neutral mediators＇ discourse roles. At the same time, it reveals such mediation strategies going against the mediation principles of being self-willingness, neutrality and up- rightness, aiming at shedding light on how to regulate strategical mediation discourse expressions and promote the mediation towards successful mediation and establishment of social harmony.
