边疆治理现代化进程中的乡规民约探析

摘　　要：边疆治理现代化是一种现代化的理性过程,也是一种运用多维治理手段的系统性过程。相对于现代化特征更为明显的国家腹地,乡规民约在传统社会特征更为突出的偏远边疆村落社会这一特殊的治理生态之下,其实践空间显然更为广阔。大致而言,乡规民约在边疆治理现代化进程中能够发挥法律规制补充、基层群众自治、社会道德自律、社会风尚引领等四个方面的功能。然而,就乡规民约在边疆治理中的实际效果而言,时常会表现出非理性化和非规范性的一面。因此,需要通过纳入法治轨道、纠正错误观念、融入基层自治、创新操作技术,推进乡规民约的规范性建设。The modernization of borderland governance is a kind of rational process of modernization,and also a systematic process of using multidimensional governance means. Compared to national hinterland whose modern features are more obvious,the village rules and regulation clearly has more space for the implementation,under the special governance of the ecology of the frontier village society which is more prominent in the traditional features. Generally speaking,the village rules and regulations can play the role of the four aspects in the process of modernization of border governance： the supplementary of legal regulation, the function of the grass-roots autonomy,the social moral self- discipline ,the leading function of the social customs and so on. However, in terms of the actual effect of the village rules and regulations in the border governance,it may show the non-rational and nonnormative side. Therefore,it is necessary to promote the normative construction of the village rules and regulations by integrating the rule of law, correcting the wrong ideas,integrating into the grassroots autonomy,and innovating the operation technology.
