论公民平等权与民族优惠政策之间的原则

摘　　要：法律上的平等观念在政策上的体现与现实之间必然存在一定矛盾。公民平等权与民族优惠政策之间的协调一致,在于培养公民对公平、正义理念的客观认同感。当前,基于我国许多少数民族实体的现实情况,实施民族优惠政策与体现公民平等权之间的关系就更加重要。社会分层引发的一系列有关公民平等权的争议问题,可以说更多地在于人们对公民平等权中公平、正义原则的认识差异。只有将公平、正义观念以适当的原则推行,并得到社会认可,民族优惠政策的改进和维护才能成为可能。There must be some contradictions between legal concept of equality embodied in the policy and the reality. The harmony between citizens＇ right of equality and national preferential poli-cies lies in the cultivation of citizens＇ objective identification to the concepts of fairness and justice. At present,based on the reality of China＇s many ethnic entities, it is more important to implement na-tional preferential policies and reflect the equal right of the citizens. A series of controversial issues on the equal rights of the citizens due to social stratification lie more in the different awareness of fairness and justice principle about civil equality. As long as the concepts of fairness and justice can be imple-mented according to appropriate principles,and be accepted by the society,the improvement and ma-intenance of the national preferential policies can be possible.
